I thought that I would bring up a counter point to one of the points gRegor made the other day, actually it was a week ago and I did the research over the next two days and was ready to respond but was busy. You know me running my love machine and all.
He brought up the issue of the legality of the Iraqi no fly zones. Lets start with one question,
When did the United States have to start consulting or even listening to the advise or recommendations of the United Nations, let alone do what they say?
Now keep in mind this is nothing against gRegor, he probably just wasn’t informed of all the details, cause knowing gRegor if he was he would have mentioned them.
gRegor sited that the US and UK used the security counsels resolution number 688 as their legal reason for having the no fly zones. While they site SCR688, its not for legal reasons its for the evidence of the humanitarian need for the NFZ’s.
When we went to war the first time, we did our stuff and left. When we left we left two groups of people who where slightly enemies before we got there and we definitely enemies after we left. That was the Kurd’s to the north and the Shi'ite to the south.
There were numerous attacks by Saddam upon these peoples before the GW1, and without the NFZ’s these people would probably be completely bombed and dead now. This was evidenced in SCR688. And many places elsewhere.
That is the legal argument, it is for humanitarian efforts.
The only legal argument against the US and UK is that they violate UN article 2, which deals with the sovereignty of nations and that the NFZ’s go against that article. In fact it is such a big deal that no other member country of the UN has brought it up for a successful vote or even moderately successful discussion.
This is written up much better in an article I found, amongst other companion articles, but I will site just this one for its clearness and ease of understandability.

This war is not pre-emptive, resolution after resolution (about 14 of them) since the first war have told Saddam to stop harming his people and to disarm.
He still has not.
Weather he has weapons of mass destruction is not an arguable point. He had them, he admitted he had them, he let the UN inspectors view many of them, and destroy some of them. He has not accounted for the ones that they did not destroy.
If you look at the protesters out their in the streets many of them are either “anti-America” stating that America is bad, and needs to be beat down, or they are “anti-Bush” they don’t like the fact that GWB won the election, and is now President. Even though just a few months ago (9-11 aftermath) they couldn’t agree more that they were glad Gore wasn’t. A good many of the protestors think they are doing something really important and are proud that they are standing up against the US and its actions. When in fact they are just using their constitutional rights. The right to free speech, I didn’t see them doing that in Baghdad they whole time Saddam was killing his people, I didn’t see them doing that during Kokako, and Bosnia, or while Clinton dropped 450 scuds on Iraq during the Monica Trails. Where were they then?
It was reported that there were 1 million protestors out the other weekend, for starters most of the big protests were set up and organized by Communist Organizations. If you want to believe in communism that is fine, but look at its track record of Human Rights Violations, its track record of “desperately hungry” populations, and the mass death left in its wake. A few example for you to look up are the former USSR, the former East Germany, the former S. Korea, the current N. Korea, the current N. Vietnam, the current China, Cuba, Iraq. Look at the millions of people who have died and the millions dieing right now. Back to my main point at the beginning of this paragraph, which was 1 million protestors in the US. That is barley, 1/3rd of a percent of the US population. The number is slightly lower then 0.33 of one percent. Not that all the 99.66% left support the war, but just pointing out that one million people aren’t that many.
As far as international support all of the EU countries except France support the war, and 15 “wannabe” EU countries support the war. The support for it in the middle east is high, none of those countries want this lunatic dictator for a neighbor. Not Egypt, Jordan, Iran(who are on the “Evil Triplets” list, Kuwait, Turkey, Israel, etc, etc, etc.
I could on but I won’t. Oh yea one last thing, ole Jok Cherok, the pres of france, he is butt buddies with Saddam. That is why, or a reason why he is so vigorously against this continued war. I meant to spell his name wrong by the way, its my personal protest against the French.

Hey Casey, I'm a lot behind on xangas, just saw this today. I don't have a lot of time right now, but I did just want to say that I agree with what you're saying about the UN - why does the US have to listen to them? I don't like the UN much at all, in fact I think we'd be better off without it. That's a whole other topic. :-]
I didn't read over all the articles, but I did read the "legal argument of NFZs" link (which you summarized in your post) -- and my main point is that Iraq never ceded their airspace, thus our bombings - whether they're done in the name of "humanitarian" or not - are not legal. I don't agree with the argument put forth (although the author didn't agree either) that human rights violations nullify a nation's sovereignty.
Think about it, basically that point of the argument is saying that the UN (or other nations in general) can supercede a nation's sovereignty based on "human rights violations" - do a bit more of "reinterpretation" of the phrase "human rights violation" and we have a one-world mommy state fastly approaching.
Anyway.. I'm actually in the process of writing an essay on this entire topic.. in-depth, with as many resources as I can get. Despite how anti-war I may sound, I'm not a pacifist, and I really just want the truth, so I don't think I'm really that biased. Two months ago I would have supported this war, but that's because I knew jack squat about it.
